These Terms of Use (Terms) govern your access to and use of the Atelia website at www.atelia.ai, the Atelia preview at atelia.kenway.biz, and any product, demo, content, or service we make available (together, the Service).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
These Terms are entered into between you and ATELIA LIMITED, a company registered in England and Wales under company number 17073257, with registered office at 167-169 Great Portland Street, London, England, W1W 5PF.
We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for lawful personal or internal business purposes, subject to these Terms.

The Service and all content within it, including the Atelia brand, logos, designs, copy, code, datasets, scoring outputs, and AI-generated explanations, are owned by ATELIA LIMITED or its licensors and are protected by intellectual property laws. Atelia, ATELIA.AI, the Atelia logomark, and related visual identifiers are trademarks of ATELIA LIMITED.
Nothing in these Terms transfers any ownership of intellectual property to you. You may not copy, reproduce, distribute, modify, publish, or create derivative works of any part of the Service without our prior written consent, except for ordinary personal viewing and use as expressly permitted by these Terms.
When you submit content to the Service, including queries, messages, feedback, or other input (User Content), you retain ownership of that content. You grant ATELIA LIMITED a worldwide, royalty-free, non-exclusive licence to use, host, store, reproduce, modify, create derivative works of, and display the User Content solely for the purposes of operating, improving, and providing the Service, and for internal research and development.
Where User Content includes personal data, we will process it in line with our Privacy Policy.
The Service may contain links to or integrate with third-party services, including the Atelia preview at atelia.kenway.biz and external sites. We do not control these services and are not responsible for their content, policies, or practices. Your use of any third-party service is subject to that service's terms and policies.
Atelia produces outputs generated by artificial intelligence, including fabric explanations, scoring, "why this" reasoning, recommendations, and advisories. These outputs are produced by AI systems that:
You agree to use Atelia's outputs as guidance and not as the sole basis for a purchase, business, or other material decision. ATELIA LIMITED is not liable for outcomes resulting from your reliance on AI-generated outputs.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ATELIA LIMITED disclaims all warranties, conditions, and representations, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, uninterrupted access, and freedom from defects.
We do not warrant that the Service or any AI output will meet your requirements, be available without interruption, or be free of errors.
To the maximum extent permitted by law, ATELIA LIMITED, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunity, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising out of or relating to the Service, whether in contract, tort, statute, or otherwise, shall not exceed one hundred pounds sterling (£100), or, if greater, the total amount you paid us for the Service in the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by applicable law.
You agree to indemnify, defend, and hold harmless ATELIA LIMITED, its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your User Content, or your misuse of the Service.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected breach of these Terms.
You may stop using the Service at any time. Sections that by their nature should survive termination (including sections on intellectual property, AI output, disclaimers, limitation of liability, indemnity, and governing law) will survive.
We may update these Terms from time to time. When we do, we will update the effective date at the top. Where the changes are material, we will take additional steps to bring them to your attention. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that we may bring proceedings in any court of competent jurisdiction to protect our intellectual property rights or seek injunctive relief.
